What constitutes 'being arrested'?

    You are all far too sensible. I feel aggrieved and pressured and I don't know why! Maybe it's that Catholic upbringing: I'm carrying around a burden of Original Sin so subconsciously want to be collared and punished. Gosh... all far too deep for a busy Friday when I ought either to be working or riding around the leafy lanes.

    Sorry, I havent read all the posts but quite frankly I have no objection to being pulled over and allowing coppers to try and do their difficult job if it means more uninsured drivers are taken off the road and the danger to me is decreased. It has nothing to do with you fella, I have been pulled over on these random checks a couple of times.

    I was about to say that its because you look better than Richard...but on second thoughts, since he was pulled aswell...maybe the argument stands up better if I said you looked the same...

    No...that doesn't work either....:confused:...Can't imagine Richard with long dark hair and a skirt...maybe Les...but not Richard...:D

    To go back to the original point, there is a diiference between being stopped and arrested.

    To be arrested, said copper must lay hands on said subject and utter the words "I am arresting you" or "You are under arrest" which in affect deprives you of your liberty. There is the opportunity to de-arrest which I won't go into, but usually if you are arrested you will also be taken to the local cop shop where there are other procedures that have to be observed.

    Additionally there are only certain circumstances when someone can be arrested.

    In your case you were simply stopped and checked, and a copper only has to say that he stopped you to ensure that you were licenced to drive that class of vehicle and the stop becomes justified and lawful.

    As someone else has mentioned, your type of vehicle often stereotypes the profile of those who do have something to hide and are therefore worthy of a pull, in the same way as some jobsworth coppers target motorcycles because they are biased in believing that none of us have insurance or licences, despite the fact that many people have paid more for their bike, kit and insurance combined than the average joe pays in some cases for the brand new 4 wheel equivelant, but that is a subject for another day.

    But I hope that answers the query regarding what constitutes an arrest.
