What constitutes 'being arrested'?

    Assuming the potential arrestee is, to use the police term "compliant", aren`t you supposed to be told

    1. You are under arrest
    2. The reason for that arrest e.g. careless driving contrary to section 3 of the road traffic act 1991
    3. Read a caution "You do not have to say anything but it may harm your defence if you do not mention, when questioned, something you later rely on in court. Anything you do say may be given in evidence"
    I appreciate that there are other circumstances where this isn`t practical (arrestee giving it legs).

    Yeah, lots of things are supposed to happen but don't. Lagunas were supposed to honour my warranty but...didn't.;)

    I was being simplistic, for the purposes of differentiating between being arrested and simply being stopped, but yes you do have to give them the short caution, and why they are being arrested except in certain circumstances, but to be arrested it still in essence requires the arresting copper to lay hands and tell the defendant that they are under arrest.
