insurance ifo

    Hi all,my dave was driving home and a tree fell on the car,he's all ok,but the cars not5oes anyone where we stand on insurance,do we claim of ours or can we claim of theirs if it came from there property.what do ya rekon

    Probably theirs, but you will have to inform your company , so they can contact the tree's owner. Trees shouldn't get blown over, it was probably diseased or grown in the wrong place!!! Nice talkin MX5s with you last night Lisa!

    depends i think there is a duty of care with regards to trees near to the roadside but then with the winds and dry weather the chances are it will be called an act of god. hoping your fully comp as thats the only way to ensure a pay out.

    Claim on your Car Insurance' assuming it is comprehensive cover, as it is classed as "property damage". Let them sort out the tree issue.
    Had Dave been walking and the tree hit him, then you would claim against the person who was/is responsible for the tree as a public/private liability.

    I'm with Tom, unless the Owner of the tree has been notified or warned that his tree poses a potential danger because it diseased, dying or rotting, then it will be an act of god (shit happens) clause. Thats why you have your own insurance. As he has not been negligent and it was a windy night, he will likely not be found liable.

    Your insurers should be able to tell you in any case.

    ...at least Dave is all good.

    In the insurance world an “act of God” is a very specific event in which the human participants have absolutely no influence or control over either cause or effect. Simply put, acts of God are considered for things like earthquakes, hurricanes, hail storms, and even animals that might cross your path and cause an accident. Most car insurance policies that provide collision and comprehensive coverage will pay for acts of God because there are no other incident participants who can be held liable.

    Very happy Dave's ok. But your poor car! Without being indelicate, did the tree fall on the car or did, perchance, the car fall sideways onto the tree?
