I feel sorry for the van driver. Must have been a dreadful shock for him and his van was damaged, too. Really lucky that nobody was hurt. I have to agree with you, that the ban seems a bit keen when you compare it to other crimes.

i understand what your saying about it seeming a bit harsh but when you consider the consequences had the accident taken a turn for the worse ....bike is propelled into the windscreen of the oncoming van, bike takes out a pedestrian, bike or rider takes out a pedestrian or another rider ???? the list is endless ...apply anyone of those and suddenly he is looking at manslaughter which........
"In England and Wales manslaughter has a "discretionary" life sentence, as opposed to the mandatory one for murder. This means the judge's discretion is used. He could impose any sentence at all, from an unconditional discharge, which means a conviction is recorded but no punishment given, right up to life imprisonment, or even a fine. Fines for manslaughter are normal where the defendant is a company rather than an individual (although it is usually easier to prosecute in such cases as a health and safety breach, as the punishment is the same and the conviction easier to obtain). An individual can expect a sentence of a few years.

The point of manslaughter compared to murder is that murder is an intentional act with an element of forward planning. Manslaughter is not and can be simply an act of negligence."
when its looked at that way ....he got off very very lightly.
Im no angel and will never claim to be and like this guy i too have made some bad decisions in my time as to when and where i flaunt the law, touch wood ive gotten away with them and neither are a majority of others on the road angelic , you dont have to be wheelieing or stunting ...in fact if your traveling at 35mph in a posted 30 limit you have broken the law of the land and in the event of an accident causing a fatality you are liable to prosecution of vehicular manslaughter and like any articulated truck driver we have to realise that the moment we put ourselves aboard our machines we are taking control of a potential killing machine and any actions of negligence on our part are accountable for by us ....yes i know it seems a harsh way of looking at it but 4 yrs of being prohibited from being in control of a vehicle??? imagine now if that was a man having shot a gun at someone and stated after " i never meant for the bullet to hit anyone" and yet the victim is standing in court paralysed from a bullet to a vital nerve, would it be harsh to ban that man from owning a gun for 4 years?....ok yes once this guy gets his license back his insurance is probably going to be a bit of a hit but should serve as a reminder .....theres a time and a place for everything and if your going to flaunt with that and you get it wrong be prepared to stand up and accept the consequenses of your actions.

oh and add to that ....following the debate of the rider who died after a car pulled out on him ....this guy saw fit to crack off a wheelie at 70mph with slower moving traffic in front of him, oncoming traffic and approaching a junction .......a "bit" of a muppet is an understatement

I agree he is a muppet but it's only when you compare the sentence that you see the rather large differences between bikers and car drivers. The same week as these two were sentenced, both got the same even the one not crashing , there was a car driver sentenced for driving the wrong way down a one way street, failing to stop for a police officer who had to jump clear to save himself all the while the driver was well over the drink drive limit and he got less. Oh and that driver was in a town so posed a much greater risk to life. That is when you start to think things aren't fair.

I am not fussed by this guys sentence so much as I am not sure I would want to ride with him but I'd much rather know the drunk driver was never getting back on the road.

    Some and some

The question is did the second rider also get his just deserts ? He got the same ban or was he even more unfairly treated?

What if the guy hadn't crashed and had controlled the wheelie ? should he still face a ban of the same length? The problem i have is dicking about on a bike for a few minutes shouldn't carry a heavier sentence than actively choosing to drink and drink.

Would i have banned him for 4 years had i been the judge? Just based on the short video we saw, no. A few months would have been his first chance. If he was a repeat offender then yes why not. There may have been a lot of other stuff on the video we won't know that.

Would i ban a drunk who goes the wrong way in a town etc ? No he would get 10 years :fume:

Would i hang a car or bike thief ? yes and i would even let little children swings baseball bats at their corpse :D

the question you have to ask yourself is...was the ban for the wheelie or for the recorded speeds in which case you have the answer for the second bike also getting done and the one to really bake your noodle is this ...he pulled a wheelie and was obviously NOT in control of his vehicle ....the active choice was to pull the wheelie......in as much as the active choice of a drink driver is to get behind the wheel whilst not not being able to efficiently control thier vehicle ...both capable of killing an innocent in the event of loss of control ( and before anyone jumps on me ..i do not condone drink driving in any way shape or form this is purely for highly debatable theories) we shall never know the bizarre reasoning behind a judges decision for any given case ...as for the car/bike thief .....screw the death by hanging just hang em an let the kids beat em to death

What I cannot understand he could have been sent to jail, but a kid of 13 got naff all for stabbing his teacher, and another pupil, all he got was some suspended sentence and anger management course I think, certainly he was not locked up

if it was for the speed then it makes the difference over 20 times that a car driver would get  a 28 day ban is often all that is handed to them for speed well over 100mph.
The active choice to pull a wheelie for a short period of time versus driving drunk is a pretty huge difference.

Do you think we could get elected at the next election based on our control of thieves? :D

and thats a real noodle baker aint it ......and i think the one that really aggravates me is getting life for murder and they are out in 25 yrs....since when was the average life expectancy 45 based on the prisoner being 20 when they were sentenced ?....life should mean life ...till dead .

the whole life debate does go on and its one that i have a big opininion on seeing that i work in that environment, the thing with a life sentence prisoner is that they are on licence till the day they die so if they have another transgression in life they can be sent to prison indefinately, all life sentences carry a minimum term to be served so it could be anything that the judge sees fit.

So another transgression means you let them out early and they kill again, when if you never let them out they never get another chance to kill an innocent person again.

Yeah that's pretty much how it goes.
